True. That would perhaps have been all the more dangerous!

Spke would not survive getting arrested. No guarantee the police wouldnt force him into the sunlight, for some reason. And he'd certainly starve on prison diet

And if a quad of cops caught on to them, he really wouldnt be able to do anything more about it than Dawn

I don't think he'd go to prison or stay there for very long. They'd have to call Buffy and Giles so I think maybe if Dawn convinced them to let Spike go the police would.

I dont know though. A guy with no ID papers, who was clearly the active part in their burglary? (he was the one picking the lock

) They may think he is a bad influence on her, and get very confused when theirt archives get no info on who he is. Maybe they'll at least consider him illegal immigrant? Whci hhe technically is

I think if Giles doesn't want to press charges they can't really do anything with him.

And I assume that it would be in the best interest of the gang for Spike not to fry in jail or be shipped back to England so they would probably make up some story that he was in fact Giles' rebellious son.
