I don't think we're even sure if she's the first clone we met. Rip said he's used 12 in the last 4 years.

And the Ava we met in the beginning was very different then one towards the later half of the season.

I still think it would make sense if the Ava from Ep 5 is different from the one in Ep 9, though that would mean Rip has set up an automatic protocol to replace an Ava clone and reinstall all/most previous memories on the new one, since he's in jail during that time.

I think that it is what he did. He couldn't be with her all the time so he had to set up something that would wake one up when another died. I think of her like the Cylons from Battlestar Galactica. When one died the memories would automatically be downloaded into the next one. Then that one would just take over. They also were different from each other depending on the environment they were in.
