It's because Voldemort has killed the parents already and Harry was old enough to be killed by Voldemort. He doesn't care if he's a child, he just wants him gone. That's how evil he is.

I can't remember if in the book he did in fact have the Invisibility Cloak during that part with Draco or if this is just that...a fan made art.

I don't remember seeing it anymore for the later movies. I don't remember what happened to it but I vaguely remember Harry passing it on to one of his children?
