Was the agreement for the film made at the beginning of DCEU before they knew they were doing Suicide Squad and the Joker in it? That's the only way I can see this happening.

I actually do not know. It seems that the solo Joker movie was announced after Suicide Squad and than they confirmed it would be a new actor which made people speculate if Jared Leto was getting replaced... and than it was announced that the movie would take place in another universe, NOT DCEU... and than this announcement came out of a Jared Leto Joker movie...

The solo Joker movie announced after SS2 wasn't official, it was a rumor at that point, same with Jared being replaced, so I'm not sure where DC was at at that point.
