Well technically he would be able to because 24 episode two hasn't even filmed yet.
With Designated Survivor, it stops filming in November or December, and only has 13 episodes for this season (thus far).
24: Legacy only filmed the first episode, and will start filming again this month. Which means by November they will only be filming episode 5. So... technically he can return to the series pretty early on.
He can do both shows and have free time if Designated Survivor gets picked up for Season 2 with 13 episodes again because the filming will start in July again and 24: Legacy would've stopped filming by then.
