Remember, Marvel made the comics all about the Avengers this century. While applying punitive rules to the X-Men like "No more new X-Men characters to be created".

Again, that was mostly due to Fox having the film rights to X-Men, sum1. The reason for the "no more new X-Men characters" rule was because any new X-Men character created by Marvel would automatically fall under 20th Century Fox's film rights. That's why they had Scarlet Witch do the whole "no more mutants" thing during House of M. Marvel Studios had the rights to the Avengers but Fox had X-Men and Fantastic Four, so Marvel was trying to starve Fox out. They even ended the Fantastic Four title for several years, remember? It wasn't until Disney bought Fox that Marvel restarted their Fantastic Four title, and now that they also have X-Men back they're creating more mutants again.

I honestly wish this could've been done another way so that Marvel could get the rights to X-Men and FF back without Disney buying all of 20th Century Fox's titles.
