I know that it was in the first book that it was gift, but it never said who gave him.. Until Sirius said that his father sent it to him, so I guess that they had the will to wait until he go to school???

So it was only confirmed that James gave it to Harry in PoA and not in PS/SS?

It was James. Though Dumbledore could've given it to Harry if James instructed him to give it to Harry but why would James do that if he can directly give the cloak to his son? Unless he knew he was gonna die so he asks Dumbledore to give the cloak instead.
