Emma's fabulous apartment doesn't come for free. It must've cost her a fortune and a long time to have such a wonderful, stable life in New York. I wouldn't be surprised if it takes a year to get there.

I think Regina didn't just change Henry and Emma's memories, but kind of the worlds. Other people would have to "remember" Emma deciding to keep Henry, there would be records at the hospital or the jail. The apartment and the new life are probably programmed into the new memories, Regina would want Henry to be looked after financially as well as emotionally, she is royalty after all.

In fact, I think the way the scene where Emma gives birth is meant to show us that up until that point, Emma's life is the same, she is found on the side of the road and never knows her parents, but when she changes her mind about Henry, that is where the alternate time line begins. If Emma had grown up differently she would not have met Neal, and Henry would never had existed at all, or would be a different child if someone else got her pregnant.

I think the jumping to a year later helps the writers skip the rebuild of the EF, while letting them flash back as needed. Plus with Ginnifer G. pregnant in the real world, it gives them time for Snow to get pregnant and look it too.

In this alternative reality, Storybrooke never exists, and Henry was raised by Emma all the time. Whatever Regina has put in her head, she never doubts it. Files of the adoption and her personal records could tell the truth, but they must be inaccessible to her. She has a new life in New York which is not made up. Though I don't know how she did it, Regina had nothing to do with it. As there is no magic outside Storybrooke, the evil queen has no influence or power, therefore she can't do anything to practically change a person's life.
