Ah, he was hard to spot this time, but there are acouple more caps from the Esterbrook scene: Fringe Easter Eggs: Fringe Episode 106: The Observer

Do you think it was the Observer that ratted out Olivia to Broyles?

Ahhh ok, well at least he was there, doing his usual.

Hmm I don't know if he ratted her out. I kind of thought the Observer was more neutral, just observing and not really taking sides, but I don't know for sure.

Actually, i don't know. I think that he's neutral and he's just there, observing things. I'm kinda sure that The Observer is related to most of the cases in some way but i couldn't say if he was a bad guy or a good one.

Maybe, but he might also be there to make sure that everything that's supposed to happen, happens. He did shoot Peter, so it can't be that he's completely passive. Maybe when he needs to take action so that an event can happen the way it needs to, he does so.

I know this has nothing to do with The Observer but Michael Cerveris has a side, I've never seen before
