Maria, maybe Kristin thought people would expect Kate to side with her "boyfriend" shrug: , but really, I think no one would be surprised by Kate siding with Jack.

ME mentioned "deals" and I think Kate's might be about her trial.
I really don't want Oceanic Six to be forced to do anything. I want their choices to be made willingly no matter how hard they may seem.

Me too. Looking at the FF now, I hope what I saw was real guilt on Jack's part, like in admission he did a mistake taking a certain decision.
But really, I can't be sure of anything when saint Jack is involved.

(I can forgive Sayid if they offered him a reunion with Nadia)

I was thinking - if we see Kate preparing eggs in the opening scene of the fourth episode, it would probably happen in her place (apartment, house).
So how will they avoid telling us who "he" is in such case?
Or maybe there is no "he" at that point in the FF, it's probably soon after the rescue. "He" might come into play later.

I had your same chain of thoughts today and came to the same conclusion.
I think this FF happens before the FF in the S3 finale, although from this part of Ryan's description of Jack and Kate meeting in the parking lot outside the courtroom:

Down in the underground parking lot for the capitol building, near the guard booth and lower entrance off Miller St., a clean-shaven, leather-jacket wearing Jack has a brief conversation with the striking, poised Kate we saw at the end of Season 3. Jack steps away from an older, brown pickup truck, not unlike the one Locke drove in one of his flashbacks, to talk to Kate. There’s some awkwardness, but there are also some smiles. Eventually, Jack helps Kate get into a yellow taxi cab, and watches as it drives away.

we know at the time of the trial he has the same leather jacket and the same car we saw in TTLG, only he is clean-shaved.

Anyway, if the "he" is a person surveilling Kate, the fact we see Kate's apartment doesn't mean we have to meet him during the trial, maybe *after* she got free she starts to work for the people who helped her.

Judging by her clothes, make-up, hair-do and shoes in the photos from ep 4 set, Kate seems to be striking, poised just like in the finale.

You're probably right, but it's so much of a repetition of the S3 finale, too much. :/ Me do not like... using the same trick isn't great, but with the same kind of scene..? Lame.

All I meant was that his cheeks are read, but your explanations could work too, I guess. Under certain influences.

That too. So many illogical things are supposed to be perfectly normal in the Lost world. It looks like a nice dose of suspense of disbilief will be needed for season 4.

OT: If you ever thought I wasn't stupid, this should convince you otherwise.
Yesterday I accidentally pressed the scroll wheel on my mouse and saw some kind of arrow on the screen. Then I realized I could sroll the page without actually moving my index finger and making that annoying sound all the time.
It only took me about 10 years.
