By Kevin Quinn ABC13 Eyewitness News (3/31/05 - Houston) — A mother was murdered, killed in her sleep. Her husband is under arrest and her two-year-old son may have been a witness. Authorities say that two-year-old boy was in his mother's bedroom when she was killed. It's unclear if the child actually witnessed the murder. But the details are becoming clearer. Detectives with Harris County say the woman was found just before 11pm Wednesday at the Trails of Windfern apartments on Windfern near FM 1960. The call came into investigators as a suicide attempt, but they say the victim did not take her own life. Elias Martinez admits he killed his wife Wednesday night, and says he now regrets it. He says he doesn't remember details of the murder, and that it happened so fast. Martha Lopez's throat was slit while she slept. Her young son was in the room. Authorities say he told them he slit the throat of Martha Lopez, 28, with a steak knife as she slept. Sgt. James Parker with the Harris County Sheriff's department said, "He is admitting to committing this crime. The motive was the fact that she was fixing to leave him and file for divorce." Investigators say Lopez had a two-year-old son, who was in the bedroom when she was killed. Javier Gonzalez, the victim's brother-in-law, says the boy was awakened by the murder. Gonzalez insists that Lopez was a passive, good person. He claims that at times Martinez became aggressive. Gonzalez says he doesn't understand what might possess his brother-in-law to snap the way Martinez says he did. Lopez's family is now asking for financial help.
