COLUMBUS, Ohio (Reuters) - The Ohio Supreme Court asserted a man's "right to procreate" on Wednesday and ruled that a father of seven could not be threatened with jail for skipping child support if he fathered more children.

Five of seven judges agreed the 2002 sentence meted out to Sean Talty was "overbroad" by threatening him with a year in jail if he fathered another child.

Talty, 32, has seven children by five different women and was $38,000 behind in child support payments.

"(The sentence) restricts Talty's right to procreate without providing a mechanism by which the prohibition can be lifted if the relevant conduct (providing child support) should change," Chief Justice Thomas Moyer wrote for the majority.

Moyer dismissed prosecutors' argument that Talty had been given a break because if he had been sent to prison on the original felony convictions for failure to pay child support for three of his children he would not have been allowed conjugal visits.

In a similar case upheld by Wisconsin's Supreme Court in 2001, a man was ordered not to have any more children if he failed to support the children he already had.

You know, while I guess it's kind of unconstitutional, I really think that people should be given lisences to have children.

who cares if its unconstitutional. if you cant support a child dont have one. we have to think of whats more beneficial to the child and/or future children

I don't think the court should ban him from having kids, but he should have enough sense to know that if he cannot support the kids he already has, he shouldn't be having more.

i don't understand why he would want more kids if he can't support the ones that he already has. i think if it gets to the point that it has then he shouldn't be allowed to have more kids.

I don't think it's him wanting more kids, it's just him being a slut and not wrapping up his tool.

I don't think it's a matter of him having more children, it's a matter of the man to take responsibility and start paying the goddamn bill. That's a *****load of money to be owing, and what do you know, even if he paid it, half of it would be taxed and go into his unemployment money.

It's time for a snip and tuck ladies and gentlemen.

I think everyone has the right to procreate, but this is rather excessive. He should have more sense than that, and start paying the money first! And hasn't he ever heard of 'condom'? Man.

As awful as not paying child support for children is you can't force people to give up their ability to procreate. This starts a slippery path of moral judgment which isn’t for any person to make on others. I certainly think that courts should have the right to take his wages if he isn’t paying.

I think we need to combat the cause of this problem. We need to spend more money on sex education. All people need to be better educated about family planning, and birth control. We should also have school sex education programs which don't just talk about not having sex, but give teenagers ways to protect themselves from pregnancy and disease. Emphasizing the importance of being emotionally ready. Also more funding for abortions and or adoptions to lower income women.
