This is an interesting theory, that someone also posted on the confessions blog. My first thought was that it would seem incredible, such a mistake: you put a man into jail and not even check he's the right one? BUT, it is sometimes true that reality rivals fiction when it comes to impossible things happening. So, never say never. EDIT: (also, this is maybe foreshadowed in the line of the cop that said: "That's inefficency"????? Hmmm, am I going too far?)
That would be the explanation for they made this weird choice to add a character with a name so similar to Cary... Or, if they weren't already planning this storyline back in season 5 when Carey was introduced, it is a way to put this weird thing into the plot in a meaningful way (and not just as a "fun fact").
On the other hand, Cary did say to Kalinda that he went to Bishop on that date, so... maybe both Cary AND Carey were there?
Again, it is still too early to know if this is just a wild theory OR maybe you guessed the big twist: but it's food for thoughts
