The copyright status for the Peter Pan property in the U.S. is disputed, but given that Disney has already demonstrated that they're not above ignoring the issue with the publishing of the Starcatchers novels, and the fact that they've already used the character of Hook tells me that they'll use and draw on whatever elements from not only the original stories but also their previous adaptations of it as they see fit.
