I don't remember all the options in Kristin's April 1 "spoilers"... I'm sure there was Juliet kissing Claire and Kate being pregnant though, lol.
Your (and Kristin's) theory makes sense, so that would justify the lawyer questioning Jack about his feelings for Kate in the trial.
But, big but, why isn't Aaron with Jack at that time? Even if he has issues with the kid, it's only natural that the little boy stays with his father while the mother is in custody/jail.
